Please read these Terms and Conditions carefully before confirming your booking or collecting the vehicle.
By confirming a booking, making payment, or filling in the drivers details form, the hirer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
1. Details and body of the contract
1.1 These Terms and Conditions apply to hire of horse boxes supplied by Nags On The Move Horsebox Hire and Transport.
Abbey Bottom farm, Harwich Rd, Wix, ESSEX CO11 2RY
These terms shall apply to the hire of the horsebox and all services that we supply to you.
1.2 A booking is not confirmed until we have accepted your booking and received any required deposit or payment. Until then, we reserve the right to decline or cancel the proposed booking.
1.3 We shall send to you confirmation in writing by post or email to the address or email address that you have given. On confirmation of your order, there shall exist a binding legal contract between us that shall be governed by English law and subject to the exclusive jurisdiction of the English Courts.
1.4 Cancellation rights are set out in section. of these terms and conditions.
1.5 You are responsible for ensuring that the vehicle you hire is suitable for the number, size and weight of the horses being transported.
1.6 We reserve the right to amend these Terms and Conditions for future bookings. Any changes will not affect existing confirmed bookings unless required by law.
2. The description of the vehicle hired, the hire period, any mileage allowance, optional extras and the total hire price will be confirmed in your booking confirmation or quotation.
2.1 The description and price of the hire services that you order will be as shown in our quotation already provided to you at the time that you place your order.
2.2 If the vehicle booked becomes unavailable due to circumstances beyond our control (including mechanical failure, accident or damage), we will use reasonable endeavours to provide a suitable replacement vehicle. If no suitable replacement is available, all monies paid for that booking will be refunded in full. Our liability shall be limited to the refund of the hire charges paid.
2.3 We shall make every effort to ensure that prices shown in our quotation are accurate at the time that you place your order. However, if an error is found, we shall inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you decide to cancel, we shall refund you in FULL for any sum that has been paid by you
3. Payment
3.1 Payment for the hire services must be made in full at the time of booking through our website. Payment can only be made via Debit or Credit card. Please note that we do not accept American Express, and there are no additional charges for paying with a credit card.
3.2 The total hire charge is payable in full at the time of booking. The hirer (driver) is responsible for the insurance excess applicable to any loss or damage occurring during the hire period. The standard insurance excess is £600. For drivers aged 23 or 24, the insurance excess is £1000. For any drivers with 6 points on their driving license is £1000 and will have to referred to our insurance company before any hire commences.
The windscreen excess is £150 and tyre damage is £150.
Any insurance excess or other charges arising from damage during the hire period are payable by the hirer IMMEDIATELY upon demand and, unless otherwise agreed in writing, no later than the return of then horse box.
By accepting these Terms and Conditions, the hirer confirms that they understand the applicable insurance excess and have the financial means to pay any excess that becomes due during the hire period.
3.3a drivers with six penalty points have a minimum of £1000 insurance access. Higher remains subject to insurer approval.If the insurer refuses cover the booking may be cancelled.
3.3 The horse box will not be released to the hirer until all monies have been paid, including full hire charge and any additional fees have been received and paid in full.
3.3a Each additional authorised driver added to the insurance policy will be subject to a £15 administration fee, payable before the commencement of the hire period. NO additional driver may drive the horse box unless they have been approved by our insures and we have confirmed.
3.4 All payments must be made securely via our website. We do not accept payments by post or any other manual methods.
3.5 A booking is not confirmed until full payment has been received and cleared. If payment is not received within the time specified, we reserve the right to cancel the provisional booking and making the horse box available to other customers without further notice or liability.
4. Collection
4.1 Unless otherwise agreed in writing, the horse box must be collected from Abbey Bottom Farm, Harwich Road, Wix ESSEX CO11 2RY.
At either 7:30pm the evening before or 7:30 am on the day of hire. Unless another time has been agreed in advance.
All horse boxes MUST be returned by 7PM on the final day of hire period.
A late return charge of £60 will apply to any horse box returned after 7pm regardless of length of the delay. Please see further down regarding more details.
4.1a Collection from 7 pm the evening before for higher period starts for the moment the horsebox is collected. Insurance and all terms and conditions apply from collection even if the booking date is the following day.
4.2 At the time of collection, you will be required to inspect the horse box and sign a vehicle handover form confirming it condition, inventory and any existing damage. By signing this form, you acknowledge that you have inspected the horse box, are satisfied with its condition, understand its operation, and accept responsibility for the vehicle for the duration of the hire period. Any pre-existing damage not recorded on the vehicle handover form will be deemed accepted by the hirer.
Any damage or defects discovered during a higher must be reported immediately
The hirer is responsible for reporting any new damage or defects upon discovery during the hire period.
4.4 We will use all reasonable endeavours to ensure that the horse box is available for collection at the agreed date and time. However, we shall not be liable for any delay or failure to make the horse box available where such delay or failure arises from circumstance beyond our reasonable control, including but limited to mechanical failure, accident or late return.
4.5 The horsebox will be supplied with a full a tank and MUST be returned with a full tank. If the horse box is returned without a full tank, the hirer will be charged for the cost of the missing fuel, together with £30 refuelling administration charge to cover our time and costs.
4.6 All drivers must complete the Drivers form which is found on our website. The horse box will not released before this is completed in full.
We reserve the right to refuse to release the horse box is satisfactory identification is not provided or the drivers details do not meet our insurers acceptance criteria. No refund will bed where the hirer fails to provide the required documentation.
5. Your right to cancel
5.1 Any request to cancel a booking must be be made in writing by the hirer. Cancellation charges will apply in accordance with the policy set below.
5.2 Cancellations request must be made in writing by email to nagsonthemove@gmail.com or by any other method agreed by us in writing. The cancellation will take effect from the date and time we receive your notice.
5.3 Once a booking has been confirmed and payment received, no cash refunds will be given.
If the hirer cancels more than five working days before the commencement of the hire, 50% of the hire fee will be retained by Nags On The Move. The remaining 50% will be issued as a booking credit, which must be used within three months of the original hire date and is subject to vehicle availability.
If the hirer cancels within five working days of the commencement of the hire, the full hire fee will be retained by Nags On The Move and no refund, credit or transfer will be offered.
6. Our promise to you
6.1 We all use all reasonable skill and care to ensure that the horse box is roadworthy, safe and in good working order at the commencement of the hire period.
6.2 We shall not be responsible for any loss, damage or defect arising from:
- Fair wear and tear
- Misuse or negligent use of the horsebox
- Failure to follow our instructions
- Failure to follow the manufacturers instructions.
- Unauthorised alterations or repairs carried out during the hire period.
- Use of the horse box for any purpose other than that for which it is intended for.
6.3 Nothing in these terms and conditions affects your statutory rights as a consumer.
6.4 If you have any other complaint regarding the hire or the condition of the horse box, you must notify us as soon as reasonably practicable by email in writing using the contact details provided.
7. During the course and duration of this contract we will:
7.1 In the event of a breakdown, the Hirer must immediately contact roadside assistance provider using the contact details displayed in horsebox. The hire must not arrange recovery or repairs through any other provider without a prior agreement except where media action is required safety reasons.
The Hirer must notify nags on the move as soon as reasonably practicable be following any breakdown over recovery.
7.2 Where the horsebox requires repair due to accident damage and misuse or negligence during hire period the cost of repairs will be assessed by a repairer or specialist approved by nags on a move or are insurers. The hire will remain liable for the applicable insurance excess and any other charges are payable under these terms and conditions.
7.3. If, before the commencement of the higher period the horsebox becomes unavailable or on roadworthy due to circumstances beyond our control we will notify the hirer as soon as reasonably practical. We will use reasonable in endeavours to provide a suitable replacement vehicle. If no suitable replacement is available all money paid for the affected booking will be refunded in full.
7.4 The hirer must not authorise or carry out any repairs alterations or modifications to the horsebox about a prior written consent of snakes on the move unless immediate repairs unnecessary to prevent further damage or insure the safety of persons or animals
8. Your obligations to us
8.1 The higher is responsible for ensuring that all drivers hold a valid driving license and meet all legal requirements to drive a horsebox. It is the hirers responsibility to ensure that they are legally entitled to drive the vehicle and comply with all the applicable laws and regulations.
8.1a the address on a driving license must match the address showing on the proof of address if satisfactory documentation not provided all the addresses do not match the horsebox will not be released and cancellation. Policy set out in these terms and conditions will apply
8.2 All drivers must be approved by nags on the move and our insurance before the commencement of hire period drivers must meet our insurance eligibility criteria including any license driving history experience requirements applicable at the time of hire.
8.3 Drivers must immediately declare any medical condition, driving conviction, accident, history or insurance matter that may affect the eligibility to drive under our insurance policy we reserve the right to refuse withdraw hire if a driver does not meet our insurers acceptance criteria.
Where a driver is accepted by our insures subject to amended insurance terms, including but not limited to and increased insurance excess the hirer will be notified before the commencement of the hire. By choosing to proceed with the hire after being notified of the amended terms, the hirer confirms that they accept and agree to be bound by those amended insurance terms and conditions.
8.4 During the hire period, the hirer agrees comply with the following obligations
Be responsible for all parking charges, tolls, congestion charges, traffic offences, fines, penalties incurred during the hire period together with any reasonable administration charges incurred by Nags On The Move.
- Pay for all fuel used during the higher period.
- Not to take the horsebox outside England, Wales or Scotland about prior written or permission.
- Collect and return horsebox at the agreed location and time
- Not to sell, lend, sublet, hire out or otherwise part with the possession of the horsebox
- The hirer confirms all information provided on a driver details form and booking is true and complete
- Not to remove alter or interfere with any identification plates, markings or equipment fitted to the horsebox
- Notify us immediately of any change to your contact details during the hire period
- Return the horsebox in a clean and tidy condition. Failure to return both the cab and horse area in a satisfactory condition will result in a £30 cleaning charge.
- Notify us immediately of any accident, damage, defect, or mechanical issues affecting the horsebox
- Ensure the horsebox is not overloaded and that all legal weight limits are complied with.
- Not too fit any time equipment or make any alterations or modifications to the horsebox about prior Whitten consent.
- Not to smoke or vape anywhere inside the horsebox.
- Only dogs, but I’ve had prior permission are allowed to travel in the horsebox.
- Not to exceed their agreed mileage allowance but daily mileage allowance is 300 miles after which an additional charge of £1 per mile will apply and must be paid on return of the horsebox. When they are special offers or coupon codes mileage limit is reduced to 100 miles by proceeding with your hire you agree to the mileage limit.
- Ensure that all horses travel at the hirers own risk are accompanied by a valid passport where required by law.
- Not use horsebox for hire or reward, sublet it, or permit any unauthorised person to drive it.
9. Ownership
9.1 The horse box remains the sole property of nags on the move at all times the hirer acquires no ownership or other rights in the horsebox other than the right to use it in accordance with these terms and conditions during agreed higher period.
9.2 The hirer must not sell, lend, sublet, mortgage, assign, dispose of or otherwise apart with possession of the horsebox no permit any other third-party to do so.
9.3 The hirer must not do or allow anything to be done, which may prejudice or adversely affect nags on the moves ownership or legal rights in the horse box.
10. Return of the vehicle and/or horsebox
10.1 At for the end of the hire period the hirer must return horse box together with all keys, documents, equipment, and accessories to the same agreed return location in the same condition as it was supplied
The hirer remains responsible for the horsebox until it has been inspected and accepted by Nags on the move.
10.2 Unless otherwise agreed in writing any horsebox returned after 7pm will incur a late return charge of £60, additional charges may also apply where the late return causes us to suffer further losses or affects subsequent bookings
It doesn’t matter whether it’s five minutes late or three hours late a £60 charge will be occurred.
If the horse box is returned later than midnight and into the following morning a full days hire Will then be charged.
10.3 The hirer shall indemnify nags on the move against any loss, damage, cost or expenses arising directly from the hirers as a failure to return horsebox in accordance with these terms and conditions.
10.4 No refund credit or reduction in hire charge will be given when horsebox is returned before the end of the agreed higher period.
10.5 If the hirers horse or pony is unable to load and horse boxe is returned early no refund, credit or transfer will be given.
11. Insurance
11.1 All Horse boxes are insured under a comprehensive insurance policy for the duration of agreed to hire period subject to the terms, conditions and exclusions of our insurer. The applicable insurance excess is detailed within these terms and conditions.
11.2 Only drivers approved by nags and move and accepted by our insurance may drive the horsebox. No other person is permitted to drive the vehicle.
11.3 The hirer is responsible for ensuring all horses, tack, and personal belongings and any other items carried in horsebox are adequately insured. nags and move accepts no responsibility for loss or damage to such property.
11.4 The hirer must not use or permit the horsebox to be used ,in any manner that breaches or invalidates the insurance policy.
11.5 In the event of an accident, theft or damage involving horsebox, for hirer must:
* notify legs on a move immediately and, where possible, within 24 hours
* not admit liability or negotiate with any third-party
* provide details of all parties and witnesses involved
* provide photograph, dash cam footage if available and any other evidence reasonably requested.
* cooperate fully with us and our insures throughout a claim.
12. Our Liability to you
12.1 We Will exercise reasonable skill and care providing a higher services and maintaining a horsebox in a roadworthy condition.
12.2 Nothing in these terms conditions excludes or limits are liability for
* death or personal injury caused by negligence
* Fraud or fraudulent misrepresentation
* any liability which cannot be excluded or limited under applicable law
12.3 except where prohibited by law nags on a move shall not be liable for any indirect, consequential, or economic loss, including loss of profits, business, opportunity, savings or goodwill arising from the hire or use of the horsebox.
12.4 we shall not be liable for any delay or failure to perform our obligations where such delay or failure is caused by circumstances beyond a reasonable control, including but not limited to adverse weather, mechanical breakdown, road closures, accidents, supplier failures, government restrictions or where the hirer has failed to provide accurate information or comply with these terms and conditions.
12.5 Where we offer a place with horsebox following unforeseen mechanical issues or other circumstances beyond under control, we shall not be liable for any additional costs incurred by the higher as a result of accepting the replacement vehicle.
12.6 The hirer acknowledges that the limitations of liability contained within these terms and conditions are reasonable and proportionate to the nature of the higher agreement.
13. Data Protection
13.1 We will collect, store and process your personal information in accordance with the UK general data protection regulation (UK GDPR) and a data protection act 2018. We will take all reasonable steps to keep your personal information secure..
13.2 Your personal information will only be used for the purposes of process, administrating your hire agreement, complying with legal obligations and, where you have consented, sending your information about our services. We will not share your information with third parties except where required by law, for insurance purposes, debt recovery, or to administer your booking.
13.3 You have the right to request access to, correction or deletion of your personal information,Subject to our legal obligations to retain certain records. Request should be made in writing to nags on the move.
13.4 The hirer is solely responsible for all parking charges, speeding offences, tolls, congestion charges, fixed penalty notice, traffic offences and any other fines or penalties incurred during the hire period.
Where any such notice is received by nags on the move after the hire has ended, we reserved the right to provide the hirers details to the relevant authority and to cover any administration charges incurred in dealing with a matter.
14. Assignment
14.1 Nags On The Move might assign, transfer, or subcontract any of its rights or obligations under these terms and conditions without affecting the hirers rights.

15.2 by proceeding with the higher and collecting horsebox, you confirm that you have read, understood and accepted these comes and conditions in full.
16 Parking at our premises
16.1 Vehicles left at our premises during high period I left entirely at the owners own risk. Nags on the move except no responsibility for loss or any damage to the vehicle or its contents.
17.Horse passport requirements
17.1 it is the hirers legal responsibility to ensure every horse transported carries a valid passport where required by law
17.2 failure to carry the appropriate documentation may result in enforcement action by the relevant authorities. Nags on a move except no responsibility for, penalties or delays resulting from a failure to carry the correct documentation.
17.3 in the event of a breakdown or accident, recovery operators may refuse to transport horses where required documentation is not available.
